Release of Liability, Assumption of Risk,
and Indemnification Agreement

This waiver is designed to inform participants of the potential risks associated with sauna use, to confirm their understanding and acceptance of these risks, and to limit the liability of the facility or property owner.

1. Acknowledgment of Risks

By agreeing to this Waiver, I acknowledge that I am fully aware of and understand the inherent risks associated with the use of a sauna. These risks include, but are not limited to:

  • Dehydration or heat exhaustion
  • Heat stroke or hyperthermia
  • Dizziness, fainting, or loss of consciousness
  • Increased heart rate or blood pressure
  • Potential aggravation of existing medical conditions
  • Burns or injuries resulting from contact with hot surfaces or equipment
  • Allergic reactions to cleaning chemicals or materials within the sauna
  • Risks associated with slipping, tripping, or falling within the sauna area

I understand that the use of a sauna may not be appropriate for individuals with certain medical conditions, such as cardiovascular disease, low or high blood pressure, respiratory issues, pregnancy, or for those under the influence of alcohol, drugs, or certain medications.

2. Representations and Warranties

I represent and warrant that:

  • I am 18 years of age or older (or have submitted a parental consent for those under 18).
  • I have consulted with my physician or healthcare provider regarding the use of the sauna, or I have chosen to use the sauna without such consultation and accept full responsibility for any resulting consequences.
  • I am not currently under the influence of alcohol, illicit drugs, or medications that may impair my ability to safely use the sauna.
  • I do not have any medical conditions, or I have received medical clearance, that would make sauna use unsafe for me.
  • I will use the sauna in accordance with all posted rules and guidelines and will act responsibly at all times while using the facility.

3. Assumption of Risk

I understand and agree that my use of the sauna is voluntary and at my own risk. I assume full responsibility for any and all injuries, losses, or damages, including death, that may occur as a result of my use of the sauna.

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Cedar Built Saunas, its affiliates, its owners, operators, employees, agents, representatives, successors, and assigns (“Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, including death, or other consequences that may be sustained by me or to any property belonging to me while participating in or using the sauna, whether caused by negligence or otherwise.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost that they may incur due to my use of the sauna, whether caused by the negligence of the Released Parties or otherwise.

6. Sauna Use Guidelines

I acknowledge that I have read and will comply with all sauna use guidelines, including but not limited to:

  • Showering before entering the sauna
  • Removing all jewelry and metal objects
  • Wearing appropriate sauna attire
  • Limiting sauna use to recommended durations (generally 15-20 minutes per session)
  • Staying hydrated before, during, and after sauna use
  • Exiting the sauna immediately if feeling dizzy, lightheaded, nauseated, or unwell
  • Not applying oils, lotions, or flammable substances before or during sauna use
  • Reporting any equipment malfunctions or unsafe conditions to staff immediately

7. Consent to Medical Treatment

In the event of a medical emergency, I consent to and authorize the facility and its staff to obtain emergency medical treatment for me. I acknowledge that I am responsible for all costs associated with any such treatment.

8. Severability

If any provision of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the state or province in which the sauna is located.

10. Entire Agreement

This Waiver constitutes the entire agreement between myself and the Released Parties with respect to sauna use and supersedes any prior written or oral agreements or understandings.

11. Acknowledgment and Understanding

I HAVE READ THIS WAIVER, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
